Welcome to 5 Stones Florist, ("we", "us", "our"), an online flower shop based in Singapore. These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Services").

By accessing our website or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

SECTION 2 - OUR PRODUCTS (FLORAL ARRANGEMENTS)

  • Freshness & Nature: Our products are fresh floral arrangements. By their natural and perishable nature, each bouquet is unique. Colours, bloom sizes, and specific flower varieties may vary slightly from website images due to seasonality, screen settings, and natural variation.

  • Accuracy: While we strive for accuracy, we do not guarantee that product descriptions, images, or colours are exact, current, or error-free. We reserve the right to update product information and to limit or discontinue any product at any time.

SECTION 3 - ORDERS & ACCEPTANCE
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. Your order is only accepted when we send an order confirmation email. We may cancel any order before delivery and will provide a full refund if we do so.

All purchases are subject to our Refund & Freshness Guarantee Policy, not a standard return policy.

SECTION 4 - PRICES, PAYMENT & GST

  • All prices on our website are in Singapore Dollars (SGD) and are subject to change.

  • Shipping and handling charges are added at checkout.

  • You agree to provide current, complete, and accurate payment information. By submitting payment details, you represent that you are authorised to use the chosen payment method.

SECTION 5 - DELIVERY IN SINGAPORE

  • We deliver within Singapore only.

  • Delivery dates and times are estimates. We are not liable for delays caused by traffic, weather, incorrect recipient details provided by you, or circumstances beyond our reasonable control.

  • It is the recipient's responsibility to ensure someone is available to receive the delivery. If no one is available, our delivery partner may leave the bouquet in a safe place at their discretion, which we are not liable for.

  • Risk of loss for the products passes to you upon delivery.

SECTION 6 - INTELLECTUAL PROPERTY
All content on our website (logos, text, images, designs) is our property or licensed to us and is protected under Singapore and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

SECTION 7 - THIRD-PARTY LINKS & TOOLS
Our website may contain links to third-party sites or use third-party tools (e.g., payment gateways). We are not responsible for their content, policies, or practices. Use them at your own risk.

SECTION 8 - RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify Inc., which provides the e-commerce platform. However, you are contracting directly with Flower Code for the sale and purchase of flowers. Shopify hosts our store and processes payments but is not a party to the transaction. You release Shopify from any claims related to your purchase.

SECTION 9 - USER FEEDBACK
Any feedback, reviews, or suggestions you submit become our property. We may use them for any purpose (e.g., marketing, improving services) without compensation to you. You warrant that your feedback is original and does not violate any third-party rights.

SECTION 10 - PROHIBITED USES
You may not use our website or Services for any unlawful purpose, to harass others, to infringe on intellectual property, to transmit viruses, or to interfere with the security or functionality of the site.

SECTION 11 - DISCLAIMER & LIMITATION OF LIABILITY

  • Limitation of Liability: To the maximum extent permitted by law, 5 Stones Florist, our directors, and employees shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits or data) arising from your use of the Services or any products purchased, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.

You agree to indemnify and hold harmless Flower Code and our affiliates from any claim or demand arising from your breach of these Terms or your violation of any law.

SECTION 13 - GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the Republic of Singapore. Any dispute shall be referred to the Singapore Mediation Centre for mediation first, and if unresolved, settled exclusively in the courts of Singapore.

SECTION 14 - CHANGES TO TERMS
We may update these Terms at any time. The updated version will be posted on our website with a new "Last Updated" date. Your continued use of the Services constitutes acceptance of the new Terms.
